ARTIST AGREEMENT

Submitting Artwork:

  • Abstract Earth Gallery has the right to edit or correct information provided by the artist in order to be consistent with our artist page format.
     

  • All artwork submitted to Abstract Earth Gallery must be original or limited-edition fine art and have been created by the artist stated. If requested, artists must be able to validate the uniqueness of their artwork.
     

  • Artist and/or the photographer should agree to make an attempt to most accurately capture the exact color and shape of the piece being photographed.
     

  • Abstract Earth Gallery has the right to refuse to display any artwork that we feel is inappropriate for the site.  Furthermore, all photographic images submitted for display on the site must adhere to quality standards as well. In the event that an image is deemed unacceptable, Abstract Earth will request new shots.
     

  • Photographs, diskettes, CD's, etc. mailed to Abstract Earth Gallery for consideration will not be returned unless they are accompanied by a self-addressed, stamped envelope/package.

Non-exclusivity:

  • We prefer, but do not require, that the pieces accepted by and displayed at Abstract Earth Gallery not be exhibited in any other online sales gallery. However, artists may not use the 3D-like rotating images on any other site without the permission of Abstract Earth Gallery.

Art Sales:

  • Artist agrees that a 30% commission will be deducted from the total selling price of each piece. Please note that a large majority of Abstract Earth Gallery clientele are large corporations who buy multiple pieces of artwork.  In certain situations, Abstract Earth Gallery may ask artists to renegotiate their commission percentages. 

  • Artwork prices must be consistent with other retail/physical gallery prices or any other online posted prices.

  • There is a 14-day return policy for all artwork. All sales are final after a period of 14 days following the initial purchase. (Abstract Earth Gallery will verify that the transaction payment has cleared before you send out your artwork to insure that the buyer possesses the adequate funds.)

  • Artwork shown at Abstract Earth Gallery must be available for sale.  Artist must notify Abstract Earth Gallery immediately if a piece being shown on our site becomes unavailable for sale.

  • Abstract Earth Gallery will notify artist immediately after a piece is sold on our site.

  • Artist may not have direct contact with the buyer unless approved by Abstract Earth Gallery (as in the case for commissioned work).

Shipping:     

  • The buyer is to assume all shipping and handling costs.  Artist is responsible for shipping artwork to the buyer within 5 days after being notified of the sale and transaction of funds.

  • Artist will include a receipt and Certificate of Authenticity with all artwork, both items to be supplied to artist by Abstract Earth Gallery.  If the package is being shipped as a gift, please exclude the receipt from the shipment.  The receipt, in this case, will be sent directly to the buyer.  Be sure to always retain a copy for your personal records.

Receiving Payment:

  • Artist will receive their payment within 30 days after the final transaction is made.  The artist will receive 70% of the total selling price of each existing piece of artwork sold through our site.

Regarding Damage:

  • Abstract Earth Gallery is not responsible for any damages incurred during shipping or installation of the artwork or at any time thereafter.

  • Abstract Earth Gallery is not responsible for any damage to artwork or equipment used in the photographic process outside of our photography studio.

Photography:

  • If artist elects to use Abstract Earth Gallery’s photography services, please refer to the photography
    contract. If the artist is not near the Columbus, Ohio area, they can package and ship the approved artwork to our studio to be photographed and promptly returned. Packaging and shipping expenses will be assumed by the artist.

  • Artist can photograph their work themselves, or refer a professional photographer to our site for the appropriate photography instructions, accessible by with the username and password supplied to the accepted artist.

  • Abstract Earth Gallery can recommend an approved professional photographer in some metropolitan areas.

Web Site:

  • Abstract Earth Gallery cannot guarantee the speed, accessibility, or the effectiveness of the web site.

  • Abstract Earth Gallery and all of its components on the Internet are protected by copyright laws:
    Nothing may be copied, reproduced, or displayed without the permission of Abstract Earth Gallery.

  • Minors may not buy or promote their artwork through Abstract Earth Gallery.

*  Both Abstract Earth Gallery and artist have the right to terminate this agreement at any time.

*  Disputes over this contract will be governed by the laws of the state of Ohio.  The venue of any claims will be held

   in the city of Columbus, Franklin County.

*  Abstract Earth Gallery may change or amend this agreement from time to time and in our sole discretion by
   posting the updated terms in Abstract Earth Gallery's online Artist Agreement.

By agreeing to display your artwork at Abstract Earth Gallery, you thereby agree to the terms and conditions of this contract.
